1. Acceptance of Terms

By accessing or using Poker Sense (“the Service”), operated by Poker Sense (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised “Last Updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Service Description

Poker Sense is a poker training and educational application that:

Provides simulated poker training hands with GTO (Game Theory Optimal) strategy feedback
Offers AI-powered coaching conversations that explain poker strategy
Tracks user training progress and identifies areas for improvement
Provides access to pre-computed poker solutions for study purposes

Poker Sense is a training tool for educational purposes only. It is not a gambling platform and does not facilitate, host, or enable real-money poker play.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent that you are at least 18 years of age.

4. Account Registration

To use certain features of the Service, you must create an account. You agree to:

Provide accurate and complete information during registration
Keep your account credentials secure
Notify us immediately of any unauthorized access to your account
Accept responsibility for all activity that occurs under your account

We use passwordless authentication (email one-time codes and OAuth providers). You are responsible for maintaining access to the email address associated with your account.

5. Subscription and Billing

5.1 Free Tier

The Service offers a free tier with limited daily usage (training hands and AI coaching conversations). The free tier is available indefinitely at no cost.

5.2 Paid Subscriptions

Paid subscription plans (“Basic” and “Pro”) provide expanded access to the Service. By subscribing to a paid plan, you agree to pay the applicable subscription fee.

Subscriptions are billed monthly on a recurring basis
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
No refunds are provided for partial billing periods
We reserve the right to change subscription prices with 30 days’ notice

5.3 Payment Processing

Payment processing is handled by our third-party payment processor. We do not store your payment card information. Your use of the payment processor is subject to their terms of service.

6. Acceptable Use

You agree to use the Service only for its intended purpose: poker training and education. You may NOT:

Use the Service as a real-time assistant during live poker play. This includes online poker, live casino poker, home games, or any setting where you are actively playing poker for real money or tournament chips. See our Fair Play Policy for details.
Use automated tools, bots, or scripts to access the Service
Attempt to scrape, extract, or bulk-download solution data
Redistribute, resell, or commercially exploit the Service’s content or data
Reverse engineer, decompile, or attempt to extract the source code of the Service
Share your account credentials with others or allow multiple users to access a single account
Use the Service in any way that violates applicable law

Violation of these terms may result in immediate account termination without refund.

7. Intellectual Property

7.1 Our Content

All GTO solution data, AI coaching content, training materials, user interface designs, and software comprising the Service are the intellectual property of Poker Sense or its licensors. You may not copy, modify, distribute, or create derivative works from this content.

7.2 AI Coaching Output

AI coaching responses are generated by artificial intelligence for your personal educational use. These responses should not be treated as professional gambling advice. You may not systematically collect, redistribute, or publish AI coaching responses.

7.3 Your Content

You retain ownership of any content you submit to the Service (such as feedback or support requests). By submitting content, you grant us a non-exclusive license to use it for the purpose of operating and improving the Service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that GTO solutions will improve your poker results
AI coaching responses are AI-generated and may contain inaccuracies
We do not guarantee uninterrupted or error-free access to the Service
Poker involves inherent risk and variance; no training tool can eliminate this

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKER SENSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR GAMBLING LOSSES.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, including but not limited to:

Using the Service during live poker play
Automated access or data scraping
Account sharing or unauthorized redistribution

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York.
